no hate crime protection also applies for gays.
hate crime legislation is bullshit. it's basically a means for prosecutors to impose more punitive sentences for the same crime. really it shouldn't matter whether the victim is asian or black or white or w/e. really if America didn't suck, the normal laws for assault, manslaughter, murder etc should be sufficient regardless of the political motivations of the prosecutor
generally speaking, though hate crime legislation isn't specifically for blacks, jews and gays it's effectively special protections for them (there are specific statutory protections, for example for gays since 2009 but it's not like whites or asians are specifically excluded). if you're talking about a white, Christian, Asian, straight victim there's many more thresholds that must be crossed that might make it simply impossible for white or straight victim to get hate crime protections. for example the white kid in St Louis who had his HEAD SET ON FIRE by a couple of black kids spurred by the Zimmerman killing, whose mom wanted hate crime protection and the DA refused.
in the case of black on asian violence the prosecutor would probably want specific and incontrovertible proof of premeditation.
in other words it isn't enough to establish that the attack itself was racially motivated (and probably also the viciousness of the beating)... proving that blacks guys attacked this guy because he was asian and had a white girlfriend but also establish that the perps:
- had specifically planned beforehand to attack an asian
- had a specific documented history of past attacks on asians or racism towards asians
and maybe even
- proof that they meant to do great bodily hard. for example they didn't just kick in his head in a fury of hate but that they had specifically planned to kick an asian in the head specifically to kill/maim him etc
there aren't firm national guidelines on what is and what is not a hate crime or what thresholds are required. therefore local prosecutors can decide with legal impunity when and when not to use it. the shorthand is that basically jews, blacks and gays get it. although hate crimes can be used broadly for "race" and "sexual orientation" there aren't there's no legal pressure to be use it consistently. it's entirely based on political pressure and blowback. basically what it means is a 2 tiered judicial system.
there's all kinds of rationalization for hate crime legislation. the most prominent is the insistence that certain groups have been targeted in the past. setting aside the stupidity of hate crime convictions in say Utah for Jim Crow era racism, and also the stupidity that individual actions TODAY should be segregated by political considerations from 60 years ago is the fact that prosecutors THEMSELVES are largely as ignorant as Moranus or the general public when it comes to the discrimination that groups... such as Asians, Mormons etc have specifically suffered in our nation's history. even if you use all that liberal nonsense rationalization Asians should be covered if they were morally consistent. but they aren't. even our asian american "activists" Like Frank are busy wringing their hands and debating whether hate crimes even exist since Vincent Chin
also generally speaking Jews passed hate crime legislation to get better leverage for themselves and are diametrically opposed to expanding it. a couple years back there were numerous notorious cases of teenagers and young adults targeting elderly homeless "bum fights" style and attacking/killing them. the ADL, Southern Poverty Law Center and other Jewish groups heavily lobbied against it. not that it would have ANY EFFECT on their own protections they just didn't like the idea of other groups being included in the chosen few that had special protections. basically those who are politically powerful like gays have elbowed themselves into the club. those without that leverage are not protected, by and large.
for the homeless as usual there was some nonsensical specious distinction that only makes sense to some liberal moranus. in this case it was insisting that Hate Crime legislation should only apply to some native trait not an economic or social condition like being homeless... even if people were specifically being targeted which met the literal professed objective of having Hate Crimes in the first place |

if you read the article they don't know if they were targeted... actually police know NOTHING but look what the media writes:
1) they're LESBIAN victims in the title. is Jew in the title of articles covering that medical school student in boston who killed from craiglist? or BLACK anywhere in the entire Do assault story?
when blacks, gays or jews are the victim, their identity becomes the central issue. when they're the perps it's never mentioned.
2) what evidence is there that they were "targeted"? none. there's literally 0 information on the case at all. and definitely absolutely 0 evidence they were "targeted"... in the absence of evidence, it's simply their identity of "being lesbian" that automatically assumes potential hate crime. any time a gay, jew or black is victimized anywhere it's pretty much assumed that hate crimes could be the motive unless specifically ruled out even in the absence of any evidence. for everyone else, it takes a lot of hard evidence (impossible evidence in many cases) but the system is always looking to give special rights and special protections to the select few. in fact the police chief does a genuflection to that special interest in this case:

3) but even this isn't enough for Moranus' media. they gotta go the full 9. they're going to plain mislead with the title and article. notice that the article actually can't make any charges of hate crime. so they obfuscate it by putting "lesbian" and "targeted" in the title so even if no charges are brought, most people think that the article is about a hate crime
in that title what does "targeted" mean? nothing. literally. targeted could be anything. targeted for a mugging, targeted for a killing etc. but to a Moranus with very little reading comprehension, critical thinking or even interest... he'll read that and think "wow gays being targeted in Texas." he'll walk away thinking these girls were targeted killed for being gay and that Texas hates gays even if none of that is in the actual article.
it'll be yet another brick in his block head where he's convinced that gays are targeted but asians are not. that texas is racist but california is not. it's like death by a thousand paper cuts. Moranus' grey matter has been bled out over 25 years of this nonsense... where he doesn't even read or comprehend what he's read but the media knows which buttons to push so that a slow dull realization bleeds into his subconscious.
to Moranus... actually reading the substance of that article doesn't matter. to him it wont matter that the article doesn't say anything about how they were targeted, let alone linking it to a hate crime. for Moranus, the media knows that literally THREE WORDS are all he will remember: lesbian, targeted, texas.
anything beyond that is verbosity, lies, contradicting authority, "confused and conflicted" and a bunch of other crap that he doesn't have the time or attention span to deal with |

VANCOUVER, Wash. – A Vancouver woman said she used her martial art skills to defend herself after she says she was groped by one stranger and verbally harassed by another last week.
Priscilla Dang was out for a run in her own neighborhood when she says the incident happened on Padden Parkway between 94th and Andresen Road last Friday.
Two teens came up to her on their bikes.
"One went in front and made eye contact with me like a smirk, like I thought he was saying 'hi.' The next thing I knew I was pretty much groped on my bottom behind left side," Dang said.
She fought back and defended herself using her training in martial arts that she's been studying for 18 years. She's been mastering the skills of Kung Fu from her older brother. The family owns Summit Wushu Academy in Clackamas that teaches Chinese martial arts.
"So I grabbed him and said, 'You need to apologize, and he did,'" Dang said.
But it escalated when she says the second teen started swearing at her.
"It just made something snap in me – it's not OK. It's so disrespectful," Dang said.
That's when her Kung Fu background really kicked in as she punched him twice in the face.
"He started coming in for a few, and I was lucky enough to dodge his shots. I came up for another one and I got him good, and I think that upset him," she said.
After the second hit, Dang said the teen pulled out a four-inch blade.
"That was when my instinct came in to back off – don't get so close because he might grab me," she said.
Two people saw the confrontation and called 911. Dang wasn't hurt but thinks the teens definitely got the message.
"I think they knew they messed with the wrong girl," she said.
The suspects are 18 and 16 years old. The 16-year-old was released to his parents, and the 18-year-old, Josiah Sullivan, was arrested.
Investigators say they never found a knife. And they say in situations like this one they recommend people avoid confrontations. |
